Last year we reported on the proposal act on the Proposal Act on unwanted control in telecommunication entities (click for full article). The proposal bill is now in preparation for formal enactment. The proposal will have far reaching impact on future merger and acquisitions practices in the telecoms landscape, which is also due to broad definitions of ‘telecommunications’ sector in the proposal, covering internet, data and telephony.
The bill is progressing now into the concrete phases in the enactment procedure, as the Ministry of Economic Affairs announced that the bill has been filed with Dutch Council of State for advice, the first formal step in the enacted procedure. After assessment and advice by the Dutch Council, the Ministry of Economic Affairs expects that the Bill will be submitted to the Lower House in summer 2018.
